Terms of Service

Welcome to ByteAi! These Terms of Service ("Terms") govern your use of the ByteAi platform, including any software, services, features, content, and application offered by ByteAi. By registering for, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

Use of the Service

ByteAi provides a platform for developers to visually assemble UML (Unified Modeling Language) class diagrams and automatically generate code using artificial intelligence. By using the ByteAi services, you agree to the following:

1. Payment

   ByteAi offers a freemium model, with basic features available for free and advanced features and additional access available for a fee. If you choose to purchase a paid subscription, you agree to pay the applicable fees and taxes. If you choose to subscribe to a paid plan, you will be billed monthly and gain access to features and limits as described in the plan of choice. If your card fails or you cancel payment, you will loose access to the additional features and will be limited to a free account. If you were using features that exceed the possibilities and limitations of a free account, such as cloud storage possibilities, you may lose access to the applicable services, unless or until the you renew your subscription. If you cancel your subscription, you will retain access to the service until the start of the next billing period. We acknowledge consumer rights under different jurisdictions, especially for cancellations, and service changes. If you are having troubles with payments or access to your premium plan and features, you should immediately contact our team at david.byteai@gmail.com.

2. Accounts and Registration

   pTo access most features of the Service, you must register for an account. When you register for an account, you may be required to provide us with some information about yourself, such as your name, email address, country of residence. You agree that the information you provide to us is accurate, complete, and not misleading, and that you will keep it accurate and up to date at all times. When you register, you will be asked to create a password. You are solely responsible for maintaining the confidentiality of your account and password, and you accept responsibility for all activities that occur under your account. If you believe that your account is no longer secure, then you should immediately notify us at david.byteai@gmail.com. ByteAi reserves the right to terminate your account for any reason, including violation of these terms of service.

3. Acceptable Use

   You are responsible for your use of the ByteAi service, and You agree not to use the Service for any unlawful purpose or in any way that interrupts, damages, or impairs the service. Prohibited activities include, but are not limited to:

   • Distributing viruses or malicious code.
   • Attempting to gain unauthorized access to the Service or other users' accounts.
   • Circumventing or attempting to circumvent any usage control or anti-piracy measures.

4. Intellectual Property Rights

   • Ownership

     ByteAi and its licensors retain all rights, title, and interest in and to the Service, including all related intellectual property rights. The Service is protected by copyright, trademark, and other laws. Your use of the Service does not grant you any ownership rights in the Service or the content you access.

   • User Content

     Users may create User Content using the Service, including visual models and code. You retain all rights in, and are solely responsible for, the User Content you create. ByteAi ensures compliance with international data protection regulations such as GDPR (EU). The data you share with ByteAi can be user for product improvement and analytics purposes, but will be protected, remain secure and will never be shared with external parties. However, please note that no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.We are not responsible for any loss of data due to cyber attacks or other unauthorized access to our systems.

5. Disclaimers and Limitation of Liability

   The Service is provided "as is" and "as available" without any warranties, express or implied. ByteAi disclaims all warranties, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. In no event will ByteAi be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service.

6. Changes to the Terms

   ByteAi reserves the right, at its sole discretion, to modify or replace these Terms at any time. Customers should check this page occasionally to ensure they are happy with any changes.

7. Governing Law

   These Terms shall be governed by the laws of Ukraine, without regard to its conflict of law provisions. By accessing our product from locations outside Ukraine, you acknowledge and agree to comply with all local laws and regulations applicable to your use of the product. Certain provisions in these Terms may not apply to all users universally due to variations in legal requirements across jurisdictions. We commit to adhere to the applicable laws and regulations in the jurisdictions we operate, including data protection and consumer rights laws.
